Solicitors and the courts have had to become more flexible and agile in managing the dispute resolution process. Court hearings now take place by video call, hearing bundles are filed electronically. The need to travel and to deliver large volumes of copy documents to the courts has greatly reduced.

Ultimately any property dispute has the potential for having to be resolved before the courts or Tribunals. We are strong advocates of a proactive approach to dispute resolution and risk management preferring to work with clients to establish an early understanding of the correct legal position, the risks and what is likely to be required to ensure the strongest possible position going forward. Most property disputes are resolved by some form of negotiation but if it is not possible to resolve a dispute it is important to be well prepared for court action.
